2. Website provisioning, server logs, and media delivery

When visiting this website, technical connection data may be processed automatically, in particular IP address, date and time, requested resource, browser type, operating system, referrer, and access status. Image files and downloads may also be delivered through external storage or infrastructure services for performance and reliability reasons.

Hosting, database, e-mail and the object storage for the photos are provided by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany, as processor under Art. 28 GDPR; servers and storage are located in Germany. Fonts, icons and country flags are served from this website itself.

The legal basis is Art. 6(1)(f) GDPR for secure and stable operation of the website.

3. Browser storage (local storage)

This website stores certain settings and shop-related data in your browser, for example language preference, dark mode preference, shopping cart contents, certificate holder name, a short purchase summary, login tokens for customer or admin areas where applicable, your privacy settings, whether you have chosen Google Sign-In on this device and whether you dismissed the language hint.

This storage is used to provide requested functions and to keep the shopping and account experience consistent across page reloads. The legal basis is Art. 6(1)(b) GDPR for requested shop/account functions and Art. 6(1)(f) GDPR for technically useful preference storage.

4. Customer account, orders, invoices, and downloads

If you register for a customer account or place an order, personal data such as name, e-mail address, optional company name (if provided for certificate or invoice usage), account credentials, order details, purchased licenses, invoices, and download history may be processed.

Processing is carried out for contract initiation and performance under Art. 6(1)(b) GDPR and, where applicable, for compliance with tax and commercial retention obligations under Art. 6(1)(c) GDPR.

This also applies to subscription products, including plan selection, activation status, included monthly download allowance, the consumption of included downloads, and the assignment of such usage to the authenticated customer account.

A new account only becomes active once you open the confirmation link we send to your e-mail address (double opt-in); unconfirmed registrations cannot be used. A change of e-mail address likewise only takes effect after confirmation from the new mailbox, and the previous address is informed. This protects against registrations with other people’s addresses (Art. 6(1)(b) and (f) GDPR).

For paid orders we store the time at which you agreed to the immediate provision of the digital content and acknowledged the loss of the right of withdrawal (proof under § 356(5) BGB, Art. 6(1)(c) GDPR). The free welcome photo is granted once per e-mail address; the 0 EUR order created for it is kept like any other order and is also used to prevent a second claim after an account was deleted (Art. 6(1)(f) GDPR).

You can change your name and e-mail address and delete your account yourself at any time under Account → Settings. Deletion removes the account, Aviation Logbook data, reviews and subscriptions; download records are anonymised, so only an anonymous count per photo remains; invoices and order records are kept only as long as tax and commercial law require (usually 8–10 years) and are then deleted.

5. Payments via PayPal

For online payments, PayPal services are integrated. When you start or complete a payment, data required for payment processing may be transmitted to PayPal, such as order amount, currency, transaction identifiers, and information necessary for fraud prevention and payment confirmation. Full payment card details are not stored on this website.

The legal basis is Art. 6(1)(b) GDPR. PayPal acts as an independent controller for its own payment processing steps.

6. Optional Google Sign-In

If you actively choose Google Sign-In (shop account and Aviation Logbook), Google Identity Services are loaded and the transmitted Google credential is used to authenticate or create your customer account. Google scripts are only loaded after you click the Google button; this choice is remembered on your device so that the Google button is shown directly next time. This feature is optional and not required for browsing the public website.

Processing takes place only after your active action and is based on Art. 6(1)(b) GDPR for the requested login process. Depending on the provider setup, data transfers to third countries may occur.

7. Verified reviews

Verified buyers may submit ratings and review texts for purchased images. Display name, rating, review text, and publication date may be shown in the gallery to other users.

The legal basis is Art. 6(1)(b) GDPR for the account-related review function requested by you and Art. 6(1)(f) GDPR for transparent product presentation.

8. Aviation Logbook

If you use the free Aviation Logbook with your customer account, the flights, sightings (spotter mode) and settings you enter are stored in our database and assigned to your account, for example date, airports, airline, aircraft, registration, seat, class, travel reason, price and notes. Imports from other platforms are processed in your browser; only the flights you confirm are transmitted.

The legal basis is Art. 6(1)(b) GDPR (use of the requested service). You can edit, export (CSV) and delete your entries at any time; when your customer account is deleted, your logbook data is deleted as well.

9. Public logbook profiles, friends and rankings

You can optionally make your logbook public under a profile address of your choice (/aviation-logbook/u/…). The public profile shows the chosen display name and your past flights with airports, airline, aircraft, registration and the resulting statistics, map and milestones. Prices, notes, booking details, times and future flights are never shown. For shared links, a preview image with name, key figures and route map is generated. Profile pages are marked as not to be indexed by search engines.

Public profiles appear in the public ranking (name, profile address and key figures) unless you switch this off in the account settings. Logged-in users can follow public profiles to compare key figures; we store who follows which profile. Followed persons are not shown a list of their followers. If you switch your profile to private, it disappears immediately from the profile page, rankings and comparisons of other users.

The legal basis is your consent by activating the public profile (Art. 6(1)(a) GDPR), which you can withdraw at any time in the account settings, and Art. 6(1)(b) GDPR for the comparison function you requested.

10. Privacy settings and external media

This website does not use tracking or advertising cookies. On your first visit you can decide in a banner whether external media may be loaded. This concerns (1) airline logos in the Aviation Logbook, loaded from the image service pics.avs.io, and (2) country photos in the travel budget calculator for countries without an own photo, loaded from Unsplash (Unsplash Inc., San Francisco, USA; images.unsplash.com). Your browser then transmits your IP address and technical request data to these providers; for Unsplash this is a transfer to the USA. The search for a matching photo runs through our server, without your IP address. Without consent, the logbook shows the airline initials and the calculator shows no photo for such countries.

The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). Your choice is stored only in your browser. You can change or withdraw it at any time via "Privacy settings" in the footer or the button below.

11. Recipients and third-country transfers

Data may be processed by hosting providers, storage and infrastructure services, payment providers, e-mail services, and authentication providers where technically or contractually necessary. If providers process data outside the EU/EEA, this takes place under the provider’s applicable contractual and legal safeguards where available.

12. Storage duration

Personal data is stored only as long as required for the respective purpose. Account and order data may be retained for the duration of the customer relationship and beyond where statutory retention obligations apply. Technical log data is generally kept only for a short security-related period.

Subscription-related status data and logs about included download usage may be retained as long as required to manage active plans, document fulfilled digital services, prevent misuse, and satisfy legal retention requirements.

13. Your rights

Under GDPR, you have rights of access, rectification, erasure, restriction, data portability, objection, and the right to withdraw any consent with future effect.

Correction and erasure are also available directly in your account (Settings → change name or e-mail, delete account). For everything else, an informal e-mail is enough.

You also have the right to lodge a complaint with a data protection supervisory authority.

Terms of Service

1. Scope

These terms apply to the use of christian-boehme.com, the gallery, the photo licensing shop, and the related customer account services.

2. Offer, checkout, and contract conclusion

Product presentations on the website do not by themselves constitute a legally binding guarantee of availability. The decisive details for a purchase are the information shown during checkout and the payment confirmation.

3. Prices and payment providers

The prices shown during checkout apply. Payment processing may be handled by external payment providers, especially PayPal. Additional provider terms may apply to the payment method you select.

This includes one-time image license purchases as well as subscription products, such as a monthly plan for EUR 9.99 or an annual billing model for EUR 99.99, if these are currently offered in the account area.

4. Digital image licenses and scope of use

Unless expressly agreed otherwise, the shop sells digital usage rights for photographs, not the copyright itself. The permitted scope of use results from the purchased license model, the product description, and any explicitly granted commercial upgrade.

4a. Free offer "Everything free"

The free offer is running right now.

The operator may offer a free promotion from time to time. Whether it is running is clearly shown on the website (notice banner, pricing page and photo pages). While the promotion is running, the following applies:

  • Users with a free registered account may download every photo of the gallery in full resolution free of charge.
  • For photos downloaded this way, a simple, non-exclusive, non-transferable right of use for private and commercial purposes is granted, without limitation in time or territory.
  • Not permitted are: passing on or selling the image files as such (e.g. in image databases, as stock photos or as templates), use as a trademark or logo, and any use that violates the law or the rights of third parties. Where customary and technically possible, the photographer is to be credited ("Photo: Christian Böhme").
  • Zines with photos from the gallery (see no. 4b) can be unlocked without a fee.
  • No paid products are sold meanwhile; in particular, no single licences, commercial upgrades or subscriptions can be booked. Licences already purchased and subscriptions already paid for remain unaffected and run until the end of their booked term. The promotion does not create a claim to a refund of amounts already paid.

The operator may end the promotion at any time with effect for the future. Rights of use to photos downloaded during the promotion continue to exist in the scope described above after it has ended. There is no claim to the promotion being held or repeated.

4b. Photo zines (zine maker)

In the zine maker, users design booklets for printing in their browser. Their own photos are processed in the browser only and are not uploaded. For photos from the gallery, a fee of €0.50 per photo used is charged for creating the print file; each photo is charged once per zine. Every registered user account can unlock one zine for free once. During the free promotion (no. 4a) the fee does not apply.

The unlock applies to the respective zine and the gallery photos it contains and entitles the user to print it for private, non-commercial purposes; selling the zines is not permitted. During the free promotion, the rights of use under no. 4a apply to the gallery photos instead.

5. Delivery, downloads, certificates, and invoices

Digital content is generally provided electronically after successful payment. Where available, downloads, invoices, and license certificates are made accessible in the success view and/or customer account.

In the case of subscription products, access may be granted in the customer account for the booked term, including a technically enforced monthly quota of included image downloads. Unused monthly allowances generally do not automatically create an entitlement beyond the technically provided plan logic unless expressly agreed otherwise.

6. Withdrawal notice for consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Christian Böhme, Lunzbergring 6, 06120 Halle an der Saale, e-mail: info@christian-boehme.com) of your decision to withdraw from this contract by means of a clear statement (e.g. an e-mail). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction (PayPal), unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal

For contracts on the supply of digital content not on a tangible medium (photo downloads, licences, subscription downloads), the right of withdrawal expires once we have begun performing the contract after you (1) have expressly agreed that we begin performance before the withdrawal period expires, (2) have acknowledged that you thereby lose your right of withdrawal, and (3) we have sent you a confirmation of the contract including this consent (§ 356(5) BGB). In the checkout, the consent is given with the checkbox above the payment button; the confirmation is sent by e-mail after payment.

Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract.)

7. Subscription plans and included download allowance

If subscription products are offered, they grant access to the contractually defined scope of digital use for the selected term only. This may include a limited monthly image-download allowance tied to the authenticated user account.

The operator may technically restrict, log, or block subscription use where monthly limits are exhausted, accounts are inactive, or misuse is suspected.

Unless expressly stated otherwise at checkout, subscription products in the current implementation are time-limited prepaid digital services. They do not automatically renew solely by virtue of account activation; instead, a new booking or a deliberate plan change in the account area may replace an existing plan.

If an immediate cancellation function is provided in the account area, users may end the subscription at any time with immediate effect. After cancellation, access to subscription-based downloads ends immediately, unless temporary access is required for technical processing, legal obligations, or abuse prevention.

8. User accounts and access data

Users are responsible for keeping their access data confidential and for providing truthful information during registration and ordering. Accounts may not be misused, transferred, or used for unlawful purposes.

9. Reviews and user-generated content

Reviews must be factual, lawful, and free from third-party rights violations. The operator reserves the right to remove content that is abusive, unlawful, misleading, or technically disruptive.

10. Availability and prohibited use

No uninterrupted availability is guaranteed. Maintenance, security incidents, force majeure, or provider outages may lead to temporary restrictions.

  • Automated scraping or bulk downloading without permission
  • Security attacks or unauthorized access attempts
  • Circumvention of subscription limits or account-based access restrictions
  • Any use that violates laws, license terms, or third-party rights

11. Liability

Liability is limited as permitted by law. Mandatory statutory liability, especially for intent, gross negligence, injury to life, body or health, and liability under mandatory product liability law, remains unaffected.

12. Applicable law

The law of the Federal Republic of Germany applies, excluding any mandatory consumer protection law of the country in which a consumer has habitual residence only to the extent legally permissible.
